1. Acceptance of Terms

By accessing or using VPNSoEasy ("Service"), operated by SendMyWayMedia LLC ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must immediately discontinue use of the Service. These Terms constitute a legally binding agreement between you and the Company.

2. Description of Service

VPNSoEasy provides virtual private network ("VPN") services, including encrypted tunneling of internet traffic, IP address masking, and secure routing through our server infrastructure using the WireGuard® protocol. The Service is designed to enhance your online privacy and security.

3. Eligibility

You must be at least eighteen (18) years of age to use this Service. By creating an account, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.

4. Acceptable Use Policy

You agree not to use the Service for any of the following purposes:

• Transmission of unlawful, harassing, defamatory, or fraudulent content
• Distribution of malware, viruses, or other harmful code
• Unauthorized access to computer systems, networks, or data
• Violation of any applicable local, state, national, or international law
• Infringement of intellectual property rights of any third party
• Sending unsolicited commercial communications (spam)
• Any activity that disrupts or interferes with the Service or its infrastructure

We reserve the right to suspend or terminate your account without notice if we reasonably determine that your use violates this Acceptable Use Policy.

5. U.S. Jurisdiction & CLOUD Act Compliance

SendMyWayMedia LLC is a U.S.-based entity. The Service is subject to United States federal and state law, including but not limited to the Clarifying Lawful Overseas Use of Data Act (CLOUD Act), 18 U.S.C. § 2713, the Electronic Communications Privacy Act (ECPA), 18 U.S.C. §§ 2510–2522, and the Stored Communications Act (SCA), 18 U.S.C. §§ 2701–2712.

Under applicable law, we may be required to comply with valid legal process — including warrants, subpoenas, and court orders — compelling the preservation or disclosure of user data. We will comply with such requests to the extent legally required.

No-Logs Limitation: Pursuant to our Privacy Policy, we do not maintain logs of user browsing activity, DNS queries, traffic destinations, or session IP addresses. Accordingly, even in response to lawful compelled disclosure, no such activity records exist to be produced. Account-level information (email, payment records, account dates) may be subject to disclosure as required by law.

6. Subscription & Billing

The Service is offered on a subscription basis. By subscribing, you authorize us to charge the payment method on file at the applicable rate for your selected plan. Subscriptions automatically renew at the end of each billing period unless canceled prior to renewal.

Pricing Changes: We reserve the right to modify subscription pricing. Existing subscribers will receive at least thirty (30) days' notice before any price increase takes effect.

Refunds: If you are unsatisfied with the Service, you may request a refund within seven (7) days of your initial purchase. Refund requests after this period will be evaluated on a case-by-case basis at our sole discretion.

7. Intellectual Property

All content, software, trademarks, and materials associated with the Service are the exclusive property of SendMyWayMedia LLC or its licensors. You are granted a limited, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose during the term of your subscription. You may not copy, modify, distribute, sell, or lease any part of the Service.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE. YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SENDMYWAYMEDIA LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY. OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE SERVICE DURING THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY.

10. Indemnification

You agree to indemnify, defend, and hold harmless SendMyWayMedia LLC and its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in connection with your use of the Service, your violation of these Terms, or your violation of any rights of any third party.

11. Termination

You may cancel your subscription at any time by emailing info@vpnsoeasy.com. Upon cancellation, you will retain access to the Service through the end of your current billing period. We reserve the right to suspend or terminate your account immediately, without prior notice or liability, for any breach of these Terms or for any other reason at our sole discretion.

12. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the United States and the State in which SendMyWayMedia LLC is organized, without regard to conflict of law principles.

Any dispute arising out of or relating to these Terms or the Service shall first be submitted to good-faith negotiation. If the dispute cannot be resolved within thirty (30) days, either party may initiate binding arbitration under the rules of the American Arbitration Association (AAA). The arbitration shall be conducted in English and the arbitrator's decision shall be final and binding. Nothing in this section shall prevent either party from seeking injunctive or equitable relief in a court of competent jurisdiction.

13. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

14. Modifications to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or through prominent notice on our website at least thirty (30) days before they take effect. Your continued use of the Service after such notice constitutes acceptance of the modified Terms.
